Law
NRS 608.018, 608.019

Does Nevada require overtime after 8 hours a day? Only for workers paid less than 1.5 times the minimum wage, unless they agree to a scheduled 4x10 week; everyone covered gets 1.5x after 40 hours in a scheduled week (NRS 608.018).

Overtime: NRS 608.018

Nevada splits workers by pay rate.

  • Paid less than 1.5 times the minimum wage: 1.5x for hours over 40 in a scheduled week, or over 8 in a workday "unless by mutual agreement the employee works a scheduled 10 hours per day for 4 calendar days within any scheduled week of work" (608.018(1)).
  • Paid at least 1.5 times the minimum wage: 1.5x only for hours over 40 in a scheduled week (608.018(2)).

Where the line sits. Section 608.018 points to "the minimum rate set forth in NRS 608.250." The Nevada Constitution, Article 15, section 16, says that "beginning July 1, 2024, each employer shall pay a wage to each employee of not less than twelve dollars ($12) per hour worked." At $12.00, the daily overtime line is $18.00 an hour (arithmetic).

One wrinkle: NRS 608.250, as printed, still lists two rates from July 2024, $11.00 where the employer offers health benefits and $12.00 where it does not. The constitution sets one rate of $12.00. The statute's text does not say which governs the overtime line, and we could not read the Labor Commissioner's guidance (labor.nv.gov blocked our connection). This page uses $18.00, the higher line, which protects more workers. Treat the band between $16.50 and $18.00 as unsettled.

Who is left out

608.018(3) lists exemptions, including executive, administrative and professional staff, workers under a collective bargaining agreement that provides otherwise, interstate truck drivers, agricultural workers, taxi and limousine drivers, some commission-paid retail staff, and "employees of business enterprises having a gross sales volume of less than $250,000 per year."

Meal and rest breaks: NRS 608.019

  • Meal: an employer "shall not employ an employee for a continuous period of 8 hours without permitting the employee to have a meal period of at least one-half hour."
  • Rest: "10 minutes for each 4 hours or major fraction thereof," not required when total daily work is "less than 3 and one-half hours." Rest periods "shall be counted as hours worked."
  • Exceptions: a workplace with only one employee, and employees under a collective bargaining agreement. The Labor Commissioner can grant further exemptions for business necessity.
