US overtime rules by state
The overtime calculator applies three sets of US rules today: federal law, California and Alaska. Texas and Florida set no overtime rate of their own, so the calculator uses the federal 40-hour rule there. Florida law (Fla. Stat. 448.01) adds one rule: a manual laborer paid by the day, week, month or year is owed extra pay for work the employer requires beyond 10 hours a day, unless a signed contract sets other hours. It does not say how much, so the calculator leaves it out.
| Rules | Overtime | Source |
|---|---|---|
| Federal | 1.5x after 40 hours in a workweek | 29 U.S.C. 207 |
| California | 1.5x after 8 hours in a day or 40 in a week, 2x after 12 hours in a day | Cal. Labor Code 510(a) |
| Alaska | 1.5x after 8 hours in a day or 40 in a week, for employers with 4 or more employees | Alaska Stat. 23.10.060 |
Each state's page is written only after its rules are checked against that state's labor department. See the US federal overtime rules, the overtime rules for every US state, or open the overtime calculator.
